MAX&MOI is not legally required to appoint a Data Protection Officer (DPO) within the meaning of Article 37 of the GDPR. Nevertheless, we have established a dedicated point of contact for any questions relating to your personal data: support@maxemoi.com
WHAT DATA DO WE COLLECT AND FOR WHAT PURPOSES?
We only collect the data necessary for the purposes described below, depending on your interaction with the website.
1. Creating a customer account
• Email address and/or customer number
• Date of birth (optional)
• Communication preferences (marketing opt-in/opt-out)
Purpose: management of your account, order history, and personalization of your experience. Legal basis: performance of the contract (account management) and consent (marketing communications).
2. Placing an order
• First name, last name
• Email address, postal address, delivery address
• Phone number
• Opt-in/opt-out preference for receiving marketing communications related to your order
• Order data (products purchased, order amount, return history)
Purpose: processing and tracking your order, invoicing, after-sales service, and fraud prevention.
Legal basis: performance of the sales contract; legal obligation for invoicing.
Payment. Payment by credit card is handled directly by our e-commerce platform, Shopify, which processes your banking information securely and in encrypted form: MAX&MOI never stores your complete banking details at any time. If you choose to pay in installments, this service is provided by our partner Alma, a payment institution authorized by the ACPR, which directly processes the data necessary for this service.
3. Newsletter Subscription
• Email address
• Consent (opt-in) provided when subscribing
Purpose: sending our newsletter and marketing communications (new arrivals, offers, brand news).
Legal basis: consent, which you may withdraw at any time (see Section 8).
4. Browsing Data
When you visit our website, certain data is automatically collected through cookies and pixels: pages viewed, products viewed, device and browser used, IP address, and interactions with the website.
Purpose: audience measurement, website improvement, and targeted advertising (retargeting).
Legal basis: consent (non-essential cookies — see Section 9).
5. Data Enrichment (date of Birth)
If you have created an account or subscribed to the newsletter with your marketing consent (opt-in) but have not provided your date of birth, we may contact you at a later date to complete this information, solely for the purpose of offering you a personalized gesture or offer on the occasion of your birthday.
You are, of course, free not to provide this information, with no impact on the other services.
6. Applications and Recruitment
Job offers and applications published on our website redirect you to our recruitment management platform, Factorial, which directly processes your application data in accordance with its own privacy policy. MAX&MOI only has access to the data necessary to review your application.

We never sell your personal data. We only share it with service providers acting on our behalf, strictly for the purposes described below:

Each of these service providers acts as a data processor within the meaning of the GDPR and is contractually committed to complying with the applicable data protection regulations.

HOW LONG DO WE KEEP YOUR DATA?
• Customer account: for the lifetime of the account, then deleted after a reasonable period of inactivity or at your request.
• Direct marketing (newsletter, marketing offers): if you have neither opened our communications nor made a purchase for more than 3 years, you will automatically be removed from our active contact database.
• Order and billing data: 10 years from the end of the relevant financial year, in accordance with our legal and accounting obligations.
• Cookies and trackers: 13 months maximum (see the dedicated Cookies section).
HOW DO WE PROTECT YOUR DATA?
MAX&MOI is committed to protecting its customers’ personal data and ensuring the highest level of protection. To this end, we implement appropriate technical and organizational measures to protect your data against unauthorized access, loss, alteration, or disclosure, and we require our service providers to maintain an equivalent level of protection.
PROTECTION OF MINORS
Our website is intended for an adult audience and is not intended for minors. We do not knowingly collect data relating to individuals under the age of 15. If you believe that a minor has provided us with personal data without the consent of a holder of parental authority, please contact us at support@maxemoi.com so that we can delete such data.
WHAT ARE YOUR RIGHTS?
In accordance with the GDPR and the French Data Protection Act (Loi Informatique et Libertés), you have the following rights regarding your personal data:

To exercise your rights, please contact us at support@maxemoi.com. We will respond within 1 month of receiving your request, a period that may be extended to 3 months for complex requests, in accordance with the GDPR.
You can also manage your communication preferences directly (unsubscribe, update your data) via the preference management form, which is also accessible at the bottom of each of our newsletters.
If, after contacting us, you believe that your rights have not been respected, you may lodge a complaint with the CNIL (French Data Protection Authority): www.cnil.fr.

MAX&MOI uses Didomi, a consent management platform (CMP), to collect your choices regarding cookies that are not essential to the proper functioning of the website.

4. Tracking Pixels in Our Emails
When you are subscribed to our Newsletter or receive marketing communications from us, our emails contain a tracking indicator (pixel): a very small invisible image embedded in the email that allows us to know whether you open our emails, at what time, and from which type of device.
This allows us to ensure proper deliverability, adapt the content, frequency, and timing of our emails to your interests, and offer you selections and advice that reflect your preferences.
This tracking is activated only if you have given your consent when subscribing to the newsletter or creating your customer account. Withdrawing your consent to receive our marketing communications (by clicking on the unsubscribe link at the bottom of each email or via the preference management form) results in the cessation of email communications and, consequently, the associated tracking pixel.
5. How Can I Strengthen or Modify My Choices?
You can at any time:
